Welcome to Lokalt, a platform operated by Peak Pixel Media. These Terms of Service govern your use of our services and products. By using Lokalt, you agree to comply with these terms. If you do not agree with any part of these terms, please refrain from using our platform.

1. Acceptance of Terms

By accessing and using the Lokalt platform, you agree to be bound by these Terms of Service and our Privacy Policy. This agreement applies to all users of the platform, including businesses, customers, and visitors.

If you do not agree to these terms, you must not use the service. Your continued use of Lokalt following the posting of changes to these terms will be deemed your acceptance of those changes.

2. Data Collection and Usage

Lokalt collects and processes personal data as described in our Privacy Policy. This includes information collected during account creation, such as your name, email address, and profile picture, which may be provided through federated login services (Apple, Google, Facebook).

We also collect data on user interactions through Google Analytics to improve our services and enhance user experience. Images, including profile pictures, place images, and post pictures, are stored securely on Firebase.

3. User-Generated Content

Users may upload content to Lokalt, including text and images. By uploading content, you grant Lokalt a non-exclusive, royalty-free, worldwide license to use, distribute, modify, and display the content on our platform.

Users are responsible for ensuring that their content does not violate any third-party rights, including copyright, trademark, and privacy rights. Lokalt reserves the right to remove or modify any content that violates these terms or is otherwise deemed inappropriate.

You retain ownership of your content, but you agree not to post content that is illegal, offensive, or harmful to others.

User Content and Business Posts
By using our platform, you acknowledge and agree that businesses and other users may post content, including images, text, and multimedia, which may feature individuals, including yourself. When participating in any activities or content creation associated with businesses on our platform, you give explicit and informed consent to the use of your image, likeness, and any other personal data as part of that content. This consent is subject to your rights under GDPR, including the right to withdraw consent as described below.

All content posted by businesses on our platform, including images, text, and multimedia, will remain on the platform unless it violates our Community Standards or is subject to a legal takedown request. Business posts are considered important for the continuity of business operations and for maintaining a complete record of business activities on the platform.

If your image or likeness appears in a post made by a business, you acknowledge that the post may remain on the platform under the legitimate interests of the business. You have the right to request removal or anonymization of your image, which we will review and address in accordance with GDPR requirements.

You have the right to withdraw your consent for the use of your image or personal data at any time by contacting us or the relevant business. Upon withdrawal, we will cease using your image for future content but may retain content already published unless otherwise required to remove it under applicable law. Withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.

You may request the deletion of your personal data, including images, under certain conditions outlined by GDPR. We will review such requests on a case-by-case basis, balancing your rights with the legitimate interests of the business or legal obligations that may require us to retain certain content. In cases where full deletion is not feasible, we may offer anonymization as an alternative, ensuring that your identity is no longer linked to the content.

If you believe that a business post featuring your image violates your privacy rights or our Community Standards, you may report the content to us. We will review the content and take appropriate action, which may include removal if it violates our policies. The final decision to retain, modify, or remove content that includes user images remains at the discretion of the business that posted the content, subject to our review and applicable legal requirements.

Our platform complies with applicable local, national, and international laws, including GDPR. In cases where the law requires the removal of specific content, we will comply with legal obligations, which may override the terms outlined in this section.

4. Payments, Commissions, and Refunds

Lokalt provides a marketplace where transactions are processed through Stripe. Lokalt charges a commission on bookings and purchases made through the platform. The commission rate will be clearly disclosed to businesses during the setup process.

Refunds are managed according to the policies set by the businesses on the platform. Users are encouraged to review the refund policy for each transaction before completing a purchase. Lokalt is not responsible for disputes between users and businesses regarding refunds.

In the event of a refund for a product or service provided by a business, the platform reserves the right to retain any application fees associated with the original transaction. The business will be responsible for refunding only the portion of the payment they received. Stripe processing fees are non-refundable and will be absorbed by the platform in case of a full or partial refund.

Stripe handles all payment processing, compliance, and regulatory requirements, including Know Your Customer (KYC) procedures.

5. Notifications and Communications

Lokalt may send you push notifications and emails to keep you informed about your account activity, updates, and other relevant information. Users can manage their notification preferences within the app settings.

We use OneSignal to deliver push notifications. OneSignal may collect certain information, such as user IDs and email addresses, to facilitate notification delivery. By using Lokalt, you consent to the use of your data for this purpose.

Businesses on Lokalt can also send notifications and emails to their customers based on interactions and preferences. Users have the option to opt out of these communications at any time.

6. Privacy Policy and GDPR Compliance

Lokalt is committed to protecting your privacy and complying with the General Data Protection Regulation (GDPR). We collect, store, and process personal data in accordance with our Privacy Policy.

Users have the right to access, correct, or delete their personal data at any time. We take appropriate measures to ensure that your data is protected against unauthorized access, loss, or misuse.

7. Messages Between Users and Businesses

Lokalt facilitates messaging between users and businesses on the platform. These communications may include discussions about transactions, bookings, or other interactions, including those related to payments processed through Stripe.

In the event that a user requests deletion of their data, the content of these messages will be anonymized to protect the user's identity. However, the content of the messages will remain accessible to the business and Lokalt for potential legal and financial dispute resolution purposes.

This retention of anonymized message content is necessary to protect the legitimate interests of both users and businesses, particularly in cases where transaction disputes or legal issues may arise.

By using the messaging feature on Lokalt, you acknowledge and agree to this anonymization and retention policy.

8. Disclaimer of Warranties and Liabilities

Lokalt is provided on an "as is" and "as available" basis. Peak Pixel Media makes no representations or warranties of any kind, express or implied, as to the operation of the platform or the information, content, materials, or products included on the platform.

To the fullest extent permitted by law, Peak Pixel Media disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

Peak Pixel Media will not be liable for any damages of any kind arising from the use of the platform, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

9. Changes to the Terms

Peak Pixel Media reserves the right to modify or update these Terms of Service at any time. Any changes will be effective immediately upon posting on the Lokalt platform. We encourage you to review the Terms of Service periodically to stay informed of any updates.

Your continued use of the platform following the posting of changes constitutes your acceptance of those changes. If you do not agree with the modified terms, you should discontinue using the platform.
